Full Definition

A comprehensive psychiatric examination conducted to assess whether an individual has the mental capacity to understand the nature and consequences of legal proceedings against them and can rationally assist their attorney in their defense. This evaluation is distinct from assessments of criminal responsibility and focuses on present mental state rather than mental state at the time of the alleged offense. The evaluation typically includes clinical interviews, psychological testing, and review of medical and legal records.
